Spouse Working in India, can this affect H4 approval

Hi Everybody,

Here is a brief desc of my situation. I have my H1 petition approved and going to get my H1 and my spouse H4 stamped next week. The questions I have are:

1). Usually people say that if you are getting your H1 stamped then you should get your spouse H4 also togather irrespective of she is travelling immediately with you or later. Is this true? I have the same scenario, we are going to get our VISA stamped togather but she will be travelling after 4-6 months later. In this case what should we tell to the consulate officer?

2). Also my spouse is workinh in India, will they ask for any resignation letter proof of NOC certificate from my spouse employer to proove that she will be travelling with me?

On the visa form DS-160 there is an option where you can write if you plan to travel together or not. Just tell the Officer that your spouse will travel later, if asked. It is not unusual for a couple to go for H4/H1 interview together and travel on different dates.

2). Also my spouse is workinh in India, will they ask for any resignation letter proof of NOC certificate from my spouse employer to proove that she will be travelling with me?

I am not a lawyer but I know this for sure: All they care to know is if you intend to work in the U.S. while on the H4 visa (which I assume you will not). 

If you are concerned, just take whatever documentation your spouse has and tell them the truth. They may not even ask detailed questions about her job, but if they do just tell them that you are she plans to quit the job to accompany you in the U.S.

Be confident and I am sure both of you will get the visas. You are right, it will be much much simpler if you go for the visa interview together. Read about another member's H4 visa interview experience here. She has also listed some H4 visa interview questions.

It would be great if you can post your H1 visa interview here for the benefit of other applicants.

As of now, everything is ready with DS-160 filled for Dependent saying "Working for x company" and Primary applicant also having the same "Working for x company", HDFC MRV receipt, BEP letter and other documents.

We need some clarification, hope anyone can help.

1. we have 10 days for interview from today, can I resign now and tell the interviewer that I am in notice period. Will there be any issues as we both are from the same company.

In the above case, will there be a rejection for H1 as well.

or

2. Can I take up the interview after 3 months, i.e after quitting and receiving my releiving orders. In this case, I need to get BEP letter from same company with change in date and need to schedule new interview.

This should not be a problem for you if you take the interview as planned. You have to prove that you clearly understand that you cannot work on the H4 visa if asked at all.
 
I do not think there is any reason to reject the H1B but these interviews are subjective. Ask your spouse to carry all the correct paperwork.
 
To conclude, carry all the paperwork for both of you, tell them you do not want to work in the U.S. and let your spouse answer all the questions related to her employer/job in the U.S. Ask her to carry the letter of employment (Sample shown)

1. My LCA says different address from the one which I am going. But my company's immi team says "as it is less than 50 miles from wht is mentioned in LCA", it is not required to change.

2. Is client letter mandatory for H1. Can we say that My employer is X company and I am reporting to mgr in the same X company. It is the same company who is paying me when I am in US and sponsoring my trip.

Immi tm just now clarified this and said, they will issue another LCA as it is in different coast. How much time will it take for new LCA to come.. with new location and work site.

Now they r telling me to resubmit a fresh DS-160 with work site changes in it and go with the same old interview letter with new DS-160 confirmation page and HDFC receipt. But interview letter is having old CEAC bar code. they are saying it wont be a problem.

But vfs site says this.. Wht shall we do..

 

If something substantial in your situation has changed (e.g. travel plans, employment), a new DS-160 is required. Use the saved version to update your information and submit the new form. This will create a new CEAC barcode. If nothing in your situation has changed, use your original CEAC barcode when making your appointment.
Return to this website and schedule a new appointment within the validity period of the receipt following the same procedure used in making your original appointment.

My H1 visa interview with H4 dependent visa interview SUCCESSFUL!!!! Granted visa.

Thanks a lot for all your support at different stages.

As my interview date is getting closer, I have got several challenges.

1. LCA change of work site address

2. Dependent wife working - whether to quit or not - eventhough she is quitting and travelling with me.

3. DS-160 change of work site due to recent project changes which happened after DS-160 confirmation and interview appointment.

Finally as per immigration team's advice, went with new DS-160 generated Bar code with old interview letter(old CEAC code in it)

1. Security person asked for mine and dependent DS-160 confirmation, passport and interview letter.. Gave a single token for both of us.

2. Next we waited for our turn in the counter with this token number.

3. Local Visa Officer: We submitted HDFC MRV receipt, I797, interview letter, DS-160 confirmation page, passport.

4. Went to another Last counter for Bio-metric finger prints.

5. Then went to the main visa interview

Me: Hi..

VO: Hi.. Docs pls...

Gone through system for 20 sec..

VO: What is ur highest qualification.

Me: Answered.. with branch

VO: Seeing I129 and LCA, y did u change ur location

Me: when i was working in previous project, there was an opportunity which i was supposed to go. but i was not able to go as i was not holding visa. With this current project, there was critical opening which requires my skills.. explained profile for 1 min.

VO: Which place u r going now.

Me: I said the client address fully

VO: (To my wife).. when did u get married?

Dependent(wife): Answered date.

VO: Took the passports. Granted.. Chk out from VFS

  1. Fill the H1 visa holder's DS 160. 
  2. There should be an option to add a recepient.
  3. Then fill the second person's DS 160. We marked it as a joint party.

I was in the same situation but address does not matter at all. I was not even asked anything about it. As far as the letter of employment is concerned, just carry the letter from your company. Don't complicate things by mentioning a client. When you are drawing a salary from X and working for X, that is your employer.

My wife after completing MS

My wife after completing MS in Dec2010, got a full time job in an US university. She is still on F-1(OPT) valid till June2013 and yet to apply and obtain H1B.

I am working in a public sector company in India. Now I got an I-20 (of an univ in US where my wife works) and would like to apply for F-1. What are the chances of me getting F-1 visa?

Earlier, my visitor visa (to attend graduation ceremony of my wife) is rejected in Dec2010. So the consulate knows that my wife is in US.

Should I proceed to apply for F1 or wait till my wife gets H1 and then try for H4?

I should catch up my Fall-2011 MBA classes from Aug 4th.

I am sorry to hear that you could not attend your spouse's graduation party. This is hearsay but a lot of visitor visas are being rejected on the basisi of 'no ties to the home country'.

Ashok, it is really your call. 

  1. Making the choice to study entails making financial plans to support your education, quitting your current job, and starting life afresh among other things. If you have all your paperwork relating to the University ready and you are inclined to quit your job and study in the U.S. apply for the F1 visa. You will also have the advantage of the OPT on the F1 visa.
  2. In contrast waiting for your spouse to apply for H1/H4 visa will hopefully quicken things up as she is already in the job and this only needs a change of status (H1 transfer process).  Ask your wife to tell her employer to apply for her H1 immediately. August 4th is not too far and the processes take time. Act fast!

Both options are feasible but the only advantage of being on the F1 visa is the OPT angle and the chance of getting hired right after college.

Just make sure that the University has no issues in enrolling you on F1 or H4 visa.

Ashok, please tell us what you choose to do. This will help others on the forum as well.

I am planning to do H4 visas for my wife and Kids. This is first time , we are doing H4 visa process. We have several questions as below. Your help highly appreciated !!

1. Can my dependants attend H4 visa anywhere in India as they returned to India from US on diffrent visa (L1 - wife &L2 - kids)?

2. On 20-Dec-2011, my wife L1B Blanket was rejected? We are little concern about H4 as this rejection impact anything to H4?

3. Can they attend visa interview in the month of January, 2012 ?

3.  She is working on getting long leave (leave withoutpay) in her company? If she doesn't get NOC , would it be impact on anything on this H4 visa?

4.  I worked on L1 visa earlier in 2007 and 2008. My H1B visa starts on Oct, 12 2011. Can I submit w2 2008 ? I have paystubs till date will that OK for them to issue visa ?

5. I am planning to move to company B from Company A now ( H1B transfer is in process). Can I my dependants attend the visa with my current petition and visa while H1B transfer is in pending?

It is better to ask the lawyer of company A about this. You may consider doing your family's H4 visa process after your H1 transfer is successfully completed.

1. They were in US since 10/10/10 to 10/23/2011.

2. Update from my end, I have booked the appointment on 11-Jan-2012 with Hyderabad consulate.

3. Yes, I will send the 2008 W2 as well for safe side.

4. I am working in Company A  not willing to do Green Card so I thought, I wanted to move to company B who are ready to do my GC. That's is the reason behind this change(transfer).

I have check with few people on this as well, Here is my consolidated understanding that, my dependants can attend visa with my current petition and other docs now as I am still employee in Company A .

But, during their travel , if by that time, I moved to Company B , they need to carry Company B approved petition with them to avoid any issues with port of entry authorities. is  that true statement? Please correct me if understanding is wrong.?

I can wait for some time in Company A till my dependants arrived here in US for safe side

Question :  They are going to consulate with Company A petition and by that time I will receive my approved petition from Company B. Are there any confusions to the office about petition when he looked at his system ?? Or just check with my pay stubs to know where I am currently ??

I am not a lawyer and I think you should talk to one if you have so many doubts.

Now that you have already taken a date, go ahead with the plan. Send your family Company B papers if you are done with the transfer and job change by the time they are scheduled to come back (to avoid POE issues).

It's alright. People switch jobs all the time. Your case is not exceptional. Just keep sending the correct paperwork to your family as you get approval updates.

I am glad to say this My wife and kids got their H4 visa's today. They attended interview at Hyderabad.

The Visa officer asked the below questions in the Interview.

Where are you going ?

Where is your husband living ?

Where is he working?

What is your educational qualification?

Then , he smiled and said approved our visas.

I am currently working in India and My husband has already got his H1 Visa Stamped and will be travelling shortly.

Now I am PLanning to apply for H4 Visa as I plan to travel along with my husband. But i will not be resigning from my company.

I want to take 2-3 month leaves so that I can travel with him and spend some time with him.

I will be joining back my company in India.

In case my Husband's stay gets extended I may then take a long leave or resign and travel again.

1. Is it okay If I explain this whole scenario to VISA officials. Can I be asked to get a Tourist Visa Instead. (I do not wish to travel on Tourist Visa)

2. What all additional documents are required from my company in this case? Is an NOC required for my VISA stamping from my current company?

Since I am planning to get my H4 in next week or as soon as possible, a quick responce will be very helpful.

I am not a lawyer and I will try to help you based on my own knowledge. 

Remember they don't care what you do in India. All they want to ensure is that you will not work on the H4 visa whilst in the U.S. and abide by all the laws related to this visa. So, going into a lot of detail about your career plan in India is an option you should re-consider.

I will share my own experience with you. I quit my job and I had my NOC. However, this was not asked for. Instead they asked me if I intended to work in the U.S. Sonia, It is upto you if you want to carry this or not.

Just carry all paperwork and tell them that you just want to live with your spouse and fully understand that you cannot work in the U.S. :)

Is it really necessary to mention my job details instead I can say I am a Housewife and go to stamping. i got married on may 2011 and my husband is working in us on h1

soon after our marriage we both went for the interview at the same time ....... unfortunately we got query on my husbands h1 visa and after three months our visa got rejected

after 1 month my husband again tried for h1 and this time by the gods grace he got ......soon after he went to us and i didn't attend to the interview along with my husband because of some personal work

now am planing to go for the interview and i had already blocked the date and interview is in a couple of day at Hyderabad

i had already submitted some of my documents at Hyderabad visa office in advance as they mentioned in my appointment letter

now i got some doubts .friends please guide me

1 do they ask me about our first visa rejection

2 what documents should i carry at the time of interview in Hyderabad because i already submitted my vfs letter , code confirmation letter , copy of my husband i 797 and his visa copy and my pass port copy

Manvitha, it is very difficult to predict what questions would be asked during your H4 visa interview. What you can do is be prepared for possible questioning and have full paperwork to back up your case. I will try to answer your questions to the best of my ability. Remember this is not legal advice.

  1. If they ask tell them exactly what happened. Do not lie as they already know why the H1/H4 was rejected. By they way, why was the visa rejected ? 
  2. Please follow the Hyderabad Consulate instructions about the documentation to be carried. I carried my marriage documents and education documents in addition to the list you have given here.
  3. I carried it. It just supports the case but sometimes, they may not even ask for it. I always prefer to carry all documents.

Do not be tense. Be confident and get your H4 visa! Come back and tell us about your interview.

i had answered all the questions with out any confusion and finally they told that your visa got approved......

with my own experience a small suggestion to the people who are attending for the interview

be confident and be cool finally u will get itttt ...........that what i did :-)

thanks a lot for ur warm wishes and wish u the same ......... and .am traveling to US in the first week of February

here is the complete information that u had asked .....i went inside by 8 15 am and came out by 9 am ......if all the

documents are proper ........ hardly it takes half an hour to finish the interview and come out but also it depends on the

crowd inside ......for me it got late near the finger print counter becauseof huge line there........and reaming all process had

completed in few minutes .

my interview appointment was at 8:30 am
.
i reached the consulate by 7 30 am and in hyderabad consulate the security guards allowed me inside just 15 minutes

before of my appointment time i.e at 8 15 and there formal checking had done and they had told me the counter number

where i have to submit my documents......i went to that particular counter........... there they checked all appointment letter my pass port size photo ....and they suggested me go for another counter and there they took my finger prints and

finally they gave me a slip

in which a number had written ....i took the slip and went to the waiting hall and i just waited for 5 minutes and

my no was displayed on the screen in the waiting hall and also they announced my no in the mike and asked me to

report at the particular counter no ...finally i went to the counter and reported ...........

here a small information for the people who are attending for the interview with there small kids

nothing to worry your interview just finishes in few minutes ........because they allow u first at all the counters

also nothing to worry guys ..........it is quite easy to get h4 visa if u have all the proper documents

Help! H4 Visa - Advice

Hi Admin,

I have recently got my H1B and will be travelling to the US next week end. My wife will be going for her H4 visa stamping sometime next week (mostly, before I travel). She is currently employed in India and is serving her notice period. As her relieving is sometime early Feb, she will not have any relieving document by the time she goes for the visa interview. She just has an e-mail from her manger stating her resignation has been accepted and she will be relieved early Feb.Would this email serve the purpose of NOC from her employer?

 

As I am yet to travel , I will not have copies of my US payslips/W2. Would that be an issue for my wife's H4 stamping? (I was told, this is a frequently asked question).

 

Please advice. Appreciate your help.

  1. That email should be ok and she can explain her situation exactly like you have posted here... don't think it should be problem. Remember people don't want to quit their jobs, end up getting the H4 visa application rejected and not have a job to go back to..:)
  2. As you have not started working in the U.S. its ok if do not have any pay stubs to show.

Have little more complication in my wife's visa. Need your guidance on the below situation:

My H1 was processed and stamped for client/location X but I will be travelling for client/location Y. I got an approved LCA as the location is different. My DS-160, petiton and supporting documents except LCA refers to initial client/location X. Per recent development (me moving to new client/location Y), while booking for my wife's visa, we filled all the docs (including DS-160) with the new client/location Y. Could this (client/location from my H1 being different from my wife's DS-160 and other supporting docs) pose any problem?

Appreciate any guidance. Thanks in advance.

It may cause a problem or may be completely ignored as well. It's tough to say. Perhaps you can send an additional letter about the change of location signed by your manager. I think you should consult your company's lawyer on this as nobody on this forum can give legal advice.

It would be great if you can share your finidings here as your case is slightly complicated.
