My H4 visa to H1 visa transfer experience

Hello everyone,

 

I was on the H4 visa for 2 years and recently I got my H1 visa. Without getting into personal reasons for applying for the transfer, I am going to share my experience for the transfer process. This should help other H4 visa holders look for more opportunites.

 

1. First, look for an employer who will give you H1 visa. This is not easy. People will ask you to go to Consultants who charge $5000-$10,000 to get you a H1B visa sponser. 

 

2. It was not easy finding a company that was ready to hire me, especially because it is was a slump. People were getting fired;who would hire me. I kept trying and I did get a job. The company filed for my LCA, also known as the Labour Condition Application. This is important as it shows that there are not enough people in the U.S. to fill that job position and that is why they are hiring ME (a foreign born resident).

 

3. The employer also filed I-129. They paid the H1B visa fees as well. I did not have to pay for that.

 

4. Then I got a date for H1 visa interview by the USCIS.

 

5. Here is a list of documents I took for the H1 visa interview : my passport, photo, copy of DS-160 confirmation receipt, visa fees receipt, my education certificates, date of birth certificate, etc. To be safe, I also took my husband's H1  B visa information. Even though this had nothing to do with his visa, I just kept it with me to be on the safe side. 

 

6. During the interview I was asked about my H4 visa and why I applied for the H1 visa. They asked me a lot of questions on where the project implementation of the company was being done: was I deployed on site, would I report to the client company or the parent company, so on and so forth.

 

7. I think they were convinced by my answers and kept my passport for the H1 visa stamping.

 

By the way I filed for my H4 visa petition on April 1, 2010. I was able to join work from October 1, 2010.

Thank you so much Sunidhi for sharing your experience! I am very sure it will help many other H4 visa holders.  I would like to add some more relevant information:
 
1. The quota for H1 visa for year 2011 is now full. You can apply for the H1B visa quota 2012. The USCIS accepts applications from April 1, 2011. If your petition is approved you can start working from October 2011.
 
2. Why are people so focussed on getting the H1 B visa? Try for the L1 visa as well. If you were working in your home country for a company that also has an office in U.S. try contacting them to give you a job on L1 visa. L1 visa has no quota or any filing dates.
 
3. Consider getting into a doctoral/post doctoral program in any of the Universities near you.

By the way, L1 is hard to get these days. Why would any H4 people come on this visa without trying out in home country companies asking them for H1/L1. They must have tried and failed. Thats the reason they have come here hoping that things are better this side. But Hell ! things are worse , worser even for H4. They should infact make use of the skills which H4 possess and help in earning some revenues in the country . People here are less qualified to do any job which H4 possess. But still , thats the rule in Uncle Sam's country!

I am not as lucky as you are Sunidhi. I have been looking for a job in QA for almost 8 months now. I am so frustrated of sitting at home that I have started working in a grocery store for cash. I want to go back to India as soon as possible and lead a respectful life...:((
Not everyone is lucky so beware people. H4 visa is a curse and no one should waste their talent on this stupid visa..

I am totally agree with sameera , Not everyone is lucky as Sunidhi !!!.... I was searching job since last 8 months but no success yet.I am a software engineer , was working with well know company in India. Got married and shifted to USA on H4 visa. Trying for job very hard but no luck.

Getting many calls for job but no one ready to sponsor H1B .... Its very difficult to find company who sponsor H1B wihout asking for $5k-$10k fee.

Administrative processing time varies with each case. For some people, it takes only a few weeks but others have reported a wait time of a few months. Be patient and hopefully your issue will be resolved soon.

With the recession in place,

With the recession in place, it is not easy to find a job with a US company who would be ready to file your visa.

I have a H4 Visa and want to transfer it to H1B. Could you please tell me how and where can I  find such companies who would be ready to take me and file for my visa too?

Ok so I found a sponsor and I really need a very quick reply. I think I may be able to convert my H4 visa into H1 visa. The problem is that the consultant is asking for original marksheets, passport and so many originals. I am consfused: do I give originals or just a photo copy/scan? Does the government ask for so many originals? How will I get them back?

I am not a lawyer but If I were you I would be on the fence if asked for my originals. Ask the consultancy to show you the list of documents they need to send.

I do not remember submitting any originals anytime. Just be careful.

  I would like to know a few things regarding H1 visa.  With a post graduate diploma in Business  mgmt and SAP HR certificate, (4 months experience as recruiter)is it easy to find an employer in US after entering there in an H4 visa? iam interested in administration/office works also. which all educational degrees comes under H1 visa category?  For admn /office works also H1 is necessary? pls gv me a reply.

Try to develop a skill set that is in demand here, perhaps by studying a specific course. Or, try to approach a consultant who would help you find a sponsor in your field of interest.

I have IT experience of 5 years in QA. I have seen that there are jobs in QA in US, New Jersey (Thats where I am looking for) but I am a bit sceptical if the companies there will be willing to sponsor H1 visa. 

I really dont want to sit idle at home. That too after working for these many years, its really difficult to be at home .

I think with your skill set youmight just be able to find a job, if not in NJ, somewhere in the Bay Area. Try to find a good consultant who can help you find the right job. Just check the credentials of the consulting company though.

Here are a few strategies for you. Hopefully these steps will help you improve your chances of getting the H1 visa. Remember the H1B Regular quota is not full yet. For more details go to H1B VIsa Update 2012.

  • Update your LinkedIN profile. Expand your professional network.
  • Become a TIE member
  • Look for job opportunities on Career Builder.com, Dice.com, Monster.com and other job related websites. Only focus on credible websites.
  • Look for legit consulting companies that are willing to do H1B visas. Some may ask you to pay for the H1 visa fees. Stay away from those companies.
  • Spread word around that you are looking for a job.
  • Update your skills in the waiting period. It does not harm to gain new knowlege.
  • Subscribe to professional journals in your field.

You can get your H1B stamped next time you go to India.

I think  H4 to H1 is an years fight, we all come here with a hope that there is a solution to every problem. But the level of frustration goes when u figure out that MBAs are good for nothing in this country.

Can anyone help me out? I am MBA in insurance with two years of experience in insurance industry. Here evryone says that H1 is meant for technical people means IT.  

Is there anything which can help me out? Because changing the field after two years of work experience is worth, and that too when you have invested your time and money in your Masters as well. Starting from the scratch in the new field without experience is it worth?

Thanks for posting. Sorry but there is no way we can help you find a sponsor. You will have to do that on your own, and I am sure you are already looking. Try to update your skill set Haseena if you do not have any prior work experience. With your B.E. background I think you will find it fairly easy to pick up on new trends in the industry.

You should write H4 visa as your status. I do not see any point in posting otherwise.

Work experience obviously scores more brownie points but that should not deter you from looking for jobs. Also, much depends on the Consultancy/Company that files for your H1 visa. Everyone has different criteria. It may be slightly more challenging but not entirely impossible.

        I have come to US just about 2 months back as h4.I  have about 5 years of IT experience.The bad luck is that by the time i updated my resume in the jobsites,quota has already exhausted :(..unfornutate that this year it got exhausted so early.Now I am eagerly looking for h1 sponser since April is approaching and just about 2.5 months to go.With my experience,I am getting calls from some companies but many say they do not do sponsorship.I guess the only the way is  to find a good consultant who could file h1 visa for me.Can anyone help me with the contacts please!!

I was on h4 visa for one year; i have around 4 years of experience in it industry in India.

i was looking for h1b visa sponsors . Finally i got one, they filed my h1 b visa on august 24 2011, had to pay 2500$

Got rfe in Dec 2011 and my employer responded to it . Meanwhile I was searching jobs, stating already on h1 b visa, since I had experience could get through in person cleint technical interview and they offered me a job as well.

I requested them for two weeks’ time quoting some reasons and they agreed

I was hoping I would get my h1b in the by  that time and ssn as well.

But to my shock my h1b was denied. iam really disappointed

 What are my options now? Can i reapply?

I can understand your frustrations and this is rather unfortunate but not unusual..:( Anyways, there's a learning curve here and you got THIS close to getting the visa. Many people find it really challenging to find a sponsor.

For sure,  you should apply again. The H1 B quota for 2013 is about to open in a few months so start doing your homework: for example, work with your H1B sponsors again or find another company, try to eiliminate the reason which led to the denial (by the way, why was your H1 denied?), so on and so forth. File early.

This query is regarding H4 to H1B Transfer . My H1B was denied last week due to some reason that I am not aware. I am planning to go to US on H4 to stay with my husband. By that time I willl be on LOP in the current organization and my current employer to file my H1B in premium processing in the month of April .

Now if my Visa gets approved in  1 moths time since this is premium processing

1) Can i start working before October

2) Do i need to go for stamping or the approved Petition will be fine to porcees working.

Even if you apply under premium processing, you cannot start work before October. The approved petition should be fine. Next time you go to your home country, you will have to get your H1 stamped.

I seriously dont wanna study a masters for  another 2 years,but i am okay for short term courses,

so i checked in community colleges,but they dont offer a change of status visa.

Also, i ve been trying to contact consultants,They say like we do sponsor H1 visa for H4 visa holders but we dont do it now,you have to wait till oct 2012 ,only after  that we can file for you saying lik cap count is not yet full...

seriously frustrated undergoing all this process... :(

Hi am on h4 visa and my visa was extended along with my husbands h1b on june 2011. We got our visa extended till 2014 june. . But he received his I 94 form with his I797 form. In my I797 they say an updated I94 is attached but I cud not find any i94 updated and attached to my i797. What should I do?
