Suggestion needed for H4 visa

Hi I am very much impressed by this forum. I appreciate administrator nice work :)

Here is my case.

Got married in US in Oct 2010. 

Came to India ang got married traditionally in Jan 2011, went to embassy for H1B stamping (change of status)

got 221g and eventually refusal in Feb.

My employer flled amended petition, went to embassy for H1B stamping in Mar 2011, got 221g again and eventually

regusal in Aug end.

Planning to apply for H4 in Dec. 

1) What all documents/ photo albums (whatever you cold think of) should I carry with me?

2) What should I tell if a question comes about my employment? Whether I should tell I am employed or unemployed?

Which would be better answer? Currently I am unemployed but can get employed if I want to but just not taking

that opportunity for short time but if being employed in India improves the chances of stamping I can start working

for that company!

Please advise.

You have not mentioned why you got the RFE.

Usually rejection in another category of visas (H1 in your case) should not affect applying in another category (H4 in your case). As long as the applicant carries all the necessary paperwork (I'd suggest that you browse the forums on this website) and answers all the questions accurately, there is a high probability of getting the H4 visa.

What story you want to tell is entirely up to you..:)) It is ok for people to hold jobs while applying for the H4 visa. Usually these people quit their jobs after they get the H4 visa stamped. Others quit before the H4 visa interview. In either case, you just have to prove that you do not intend to work whilst on the H4 visa in the U.S.

Amazing! You're really a quick responder whatever I noticed (your reply time) and expected I got better than that. Thank you.

I never got an RFE when my sponsor applied for H1B, neither for my 1st H1B- when I was in US, nor for my amended petition- when I was in India (and my first H1B was denied already). If you mean what was asked for in 221g; in my first 221 they didn't ask anything specific and VO just asked me to submit all the documents which I had with me (that interview was at New Delhi). In 2nd attempt he gave me 221g with the documents he would want to have a closer look on to. I submitted all of them within 10 days but with no luck!

Thanks for motivational response for H4 visa.. I was expecting a link leading to the list of documents. Main benefit of that link is that would be hand picked by an expert like you and would be very helpful to a candidate like me!

I am still working for the same client and read on some of the forums that it is not suggestible to say in the interview that you're working for a US client then VO will think even if you're migrting on H4 your intention is to go there and start working for that client. If I don't reach by end of this year I might loose my contract and I am sure I would be going for visa interview by end of this year (haven't booked the date yet). Your suggestion based on your experience would be helpful what I should ans. in my interview.whether I am employed or not!

  1. SPatel, Thanks for sharing the details. Remember if you are applying for the H4 visa you have to keep in mind that you cannot work. My previous comment pretty much sums up the issues about H4 visas. It is upto you if you want to quit your current job or not.  No one here can make that decision for you..:)) People usually quit AFTER they get the visa.
  2. As long as you tell the VO that you will not work in the US on the H4 visa it does not matter what you are doing in India. That said, your case is slightly complicated and I suspect you will be asked questions about your intent to work/stay at home/previous rejections/221(g), etc. Hopefully you can get your story straight this time. 
  3. Please read Documents for H4 visa for more tips. I just shared my experience and tips for other applicants based on my H4 visa application experience.
  4. Browse H4 visa interview questions forum. That will help you to prepare for the interview. Browse other forums on the website. It will help you prepare well!

My Employer has filed H1B and i received the receipt on 24-April,2012.

My Wife wants me to get H4 stamped for my daughter and myself and travel US , stay for a month and then return back to India.

Later she wants me to get my H1B from my Employer in India.(I am going for H4 only because i have to leave baby with her mother)

Queries :

1. Will there be any problem for my H1B if i get H4 stamped first.

2. As i am coming back India with in month with my H4 what are the problems i can face in H1B interview.

3.What are the questions interviewer would ask if i am still working with an Employer in India.

4.Is it the right decision to have H4 for just a month and then come for H1B.

Please need your valuable suggestions as quick as possible.

So, your suggestion would be to just wait for my H1B.

And from May9,2012 there is new rule that children below 7 years need not go to consulate for H4 stamping it seems.(i read somewhere)

So, i am planning to get H4 for my daughter through my wife's employer and get a visiting VISA for myself stating that i want to leave my daughter and come back.

Will this be a good idea. Please suggest me .

Yes you are absolutely right about the change of rule for children under 7 years of age.  You can get the H4 visa for your daughter. 

That said, if you apply for a visitor visa, what will happen to your pending H1B application?

Dear Admin,

I have question regarding my H4 visa. Brief overview of my case is as follows:

  1. Went to US on F-1 visa and returned in Nov 2011 after completion of my course.
  2. Applied for B-1 visa in Jan 2012 and got it without hassle. Traveled to US for 2 months and returned in March 2012.
  3. Applied for F-1 visa again in May 2012. Visa got rejected under 214(B) and also cancelled my B/1 visa without prejudice.
  4. Applied again for F-1 visa in May second week. VO officer approved visa but visa went under processing and later rejected under 214(B) again.
  5. Now I am getting married to my boyfriend in August who is H1b holder and working as a physician. As I am considering appearing for H4 visa in August end or September first week which would be nearly 3 months after my previous rejection from F-1 visa. I have following questions:
  1. Lot of people suggest me that 3 month is very less time and I should consider keeping more time. As this would be my fourth visa interview of the year. Please advice according to you what would be the ideal time. Are there chances of rejection if I appear after 3 months? Will previous rejection affect by visa this time. (FYI: His H1b Visa renewal due in June 2013)

 

  1. During my previous applications for visa interview I have never said yes to the section where it is mentioned that do you have a fiancé in US, as me an my boyfriend have never been engaged. We do have lot of together pictures from before and we graduated together from the same University in US. Any specific question I can expect based on my scenario?

 

  1. I am considering taking our old pictures and out graduation degree at time of Interview along with other required documents. Any other thing you would like to suggest.

I am very concerned and any advice from you would be highly appreciated.

  1. Just go for the H4 visa interview. These are two different visa classes. Rejection in one does not warrant/necessitate rejection in another.
  2. It should not be an issue.
  3. Just take pictures of your wedding and all documents related to your marriage. Other than that carrying additional pictures is your choice. For H4 visas, they look to scrutinize issues like legal marriage and proof of marriage.

As per new rule, it is not required for a child under 7 to appear for a nonimmigirant visa interview.

I had been working in US till October 2012 after which I travelled to India for a year, currently in India

I want to travel back in a H4 now coz I and my husband need to travel back to same location. Once I travel back to US in H4, how soon can I get a H1 petition and can I get it done sooner or I need to wait for cap next year. Let me know your thoughts. Welcome to our website. Nobody shares legal advice here. Please use discretion while reviewing any content here.

Please send your divorce decree/papers for your wife's H4 visa interview. She should show them if asked. Other documents are pretty much the same for all H4 visa applicants. You must also make sure that she carries the marriage certificate, pictures of marriage as proof of marriage to you.

We don't get a lot of quesries on H4 visa divorce and remarriage but I am sure people would be willing to help if you post specific questions.

You should not have any

You should not have any problem as long as you send current paperwork with them. People change jobs all the time. I don't see the harm in going with either scenario. If your dependants go after you have changed your job, you should send current salary slips as well (from employer 2) as well as the updated petition.

I had my H4 visa stamped in March 2014 which is valid till March 2016(Prior to this I was working on L1B visa and have now resigned from my job).
 I have been now admitted into a reputed university for MBA program which would start in August 2014. Due to a family function I have to go back to my home country in June 2014 and I plan to use this visit to get my F1- visa stamped as university has now provided me the I-20 and SEVIS number. Do you think this scenario will cause any issues in stamping process and if my F1 is denied will my valid H4 visa be also cancelled without prejudice
